Creative Shot RGV – Terms & Conditions
By booking a session with Creative Shot RGV, the client acknowledges that they have read, understood, and agreed to the following terms and conditions:
1. Delivery Timeline
Edited images will be delivered within fourteen (14) days from the date of the photoshoot, unless otherwise agreed in writing.
2. Deposit and Payment
A non-refundable deposit for the chosen package is required to secure your booking. Deposits may be paid via Zelle or CashApp (a $3 fee applies for CashApp transactions). The remaining balance is due on the day of the photoshoot.
3. Timeliness
Clients must arrive on time for their session. Late arrival will result in a reduction of shooting time. A late arrival exceeding ten (10) minutes will incur a $30 late fee. Arrivals exceeding twenty (20) minutes will result in cancellation and require rescheduling, subject to availability and applicable fees.
4. Promotional Material
Creative Shot RGV reserves the right to photograph, record, and publish images and/or videos from sessions for marketing and promotional purposes, including social media, website, and printed material.
5. Rescheduling
Rescheduling requires a $50 fee. This fee may be waived if the client provides verifiable proof of an unavoidable circumstance (e.g., illness, accident, COVID-19) and notifies us within 48 hours.
6. Ownership of Work Product
All images, whether edited or unedited, remain the sole property of Creative Shot RGV and are protected by copyright law.
7. Client Affirmation
The client affirms they have full rights and permissions for all individuals to be photographed and that nothing will restrict Creative Shot RGV from using images for promotional purposes as outlined in this agreement.
8. Liability Disclaimer
Creative Shot RGV is not responsible for any injuries, damages, or losses sustained by the client or any individuals accompanying them during the session, on or off the premises.
9. Image Selection
Image selection must be completed within five (5) weeks of notification. After five weeks, a $30 late selection fee applies. If selection is not made within ten (10) weeks, Creative Shot RGV will select the images for editing.
10. Copyright & Watermark Policy
All delivered images are copyright protected and may contain a visible watermark. Removing, cropping, blurring, or altering the watermark without written permission is strictly prohibited. If a client is found to have removed or altered a watermark:
- All rights to the images are revoked.
- No refunds will be issued.
- Access to the gallery will be permanently revoked unless the client purchases the unedited gallery for $200.
- Creative Shot RGV reserves the right to pursue legal action for unauthorized use or distribution.
11. Force Majeure
Creative Shot RGV shall not be held liable for any delay or failure to perform due to causes beyond its control, including but not limited to acts of God, natural disasters, equipment failure, illness, or accidents. In such cases, sessions will be rescheduled without additional cost.
12. Indemnification
The client agrees to indemnify, defend, and hold harmless Creative Shot RGV, its owners, employees, and contractors from any claims, damages, or expenses (including attorney’s fees) arising out of the client’s actions, negligence, or breach of this agreement.
13. Limitation of Liability
In no event shall Creative Shot RGV’s total liability exceed the amount paid by the client for the specific service provided. Creative Shot RGV is not liable for indirect, incidental, or consequential damages, including but not limited to emotional distress, lost profits, or reputational harm.
14. Service Outcome Disclaimer
While Creative Shot RGV strives to produce high-quality work, no specific outcome, number of images, or poses is guaranteed. Final results depend on various factors, including but not limited to client cooperation, environmental conditions, and time constraints.
15. Model Release & Consent
By participating in a session, the client grants Creative Shot RGV permission to photograph and use their likeness, and that of any minors in their care, for promotional purposes in any format, without further compensation, unless otherwise agreed to in writing.
16. Privacy, Data Protection & Image Usage
Creative Shot RGV values your privacy and will only collect personal information necessary to provide services, process payments, and communicate with you regarding your booking. Your information will not be sold, rented, or shared with third parties, except as required by law or with your explicit consent.
17. Newborn Photography Policy
- Safety First: Creative Shot RGV prioritizes newborn safety at all times. Certain poses may be modified or omitted if the photographer determines they could pose a risk.
- Session Duration: Newborn sessions are scheduled for up to 1.5 hours to allow for feeding, soothing, and changing as needed. Additional time may be allowed at the photographer’s discretion.
- Parental Participation: A parent or legal guardian must remain present in the studio for the entire session. Parents may be asked to assist with positioning or soothing the baby.
- Health & Illness: Clients must inform Creative Shot RGV if the newborn has been recently ill, has any medical conditions, or if anyone attending the session has been exposed to a contagious illness. The photographer reserves the right to reschedule in the interest of health and safety.
- Results May Vary: Babies older than two (2) months may be less likely to achieve certain “newborn” poses due to increased movement and alertness. This may result in fewer images or different posing styles. No specific pose or outcome is guaranteed.
By booking a session, the client grants Creative Shot RGV permission to capture, edit, and use images from the session — including likenesses of any minors in their care — for promotional, marketing, and portfolio purposes in any format, including but not limited to websites, social media platforms, and printed materials, unless otherwise agreed to in writing. Images of minors will be handled with additional care to ensure privacy and will only be used in accordance with the agreed terms.
