Terms and Conditions – Event & Wedding Photography
These Terms and Conditions (“Agreement”) govern all photography services provided by Creative Shot RGV (“Photographer”) to the client (“Client”). By booking, Client agrees to the following:
1. Booking & Payments
- A non-refundable retainer is required to secure the event date.
- The remaining balance must be paid in full Day before the wedding/event date.
- Payments may be made via cash, cashapp, or zelle.
2. Cancellation & Rescheduling
- In the event of Client cancellation, the retainer is non-refundable.
- Cancellations made within 1 of the event will require full payment.
- Rescheduling requests are subject to Photographer’s availability.
3. Event Coverage
- Photographer offers two event packages:
- Basic Coverage – $100 per hour.
- Premium Coverage – $300 per hour.
- Coverage includes continuous shooting time during the booked hours.
- Any additional hours requested beyond the contracted time will be billed at the same hourly rate of the chosen package.
- Photographer is not responsible for missed shots due to restrictions at the venue, interference by guests, or other circumstances beyond control.
4. Wedding-Day Timeline & Cooperation
- Client agrees to create and follow a reasonable photography schedule for the wedding day.
- Photographer is not responsible for missed moments due to delays, last-minute changes, or failure of Client, wedding party, or guests to cooperate.
- If important individuals (e.g., family members) are missing during scheduled photo times, Photographer is not obligated to reschedule those shots.
5. Image Delivery
- Edited images will be delivered within 4 Weeks of the event date via an online gallery or other agreed method.
- Photographer will provide a curated selection of professionally edited images; RAW/unedited files will not be released.
6. Artistic Style & Editing
- Client acknowledges Photographer’s artistic style and grants Photographer full discretion in selecting and editing images.
- Editing includes color correction, lighting adjustments, and retouching at Photographer’s discretion. Requests for extensive alterations (e.g., body reshaping) may incur additional fees.
7. Copyright & Usage Rights
- All images remain the copyright of Photographer.
- Photographer grants Client a non-exclusive, non-transferable license for personal use, including printing and sharing.
- Commercial use, resale, or publication requires written consent from Photographer.
- Photographer reserves the right to use images for marketing, portfolio, and promotional purposes unless Client requests otherwise in writing before the event.
8. Model Release
- Client grants Photographer and assigns the irrevocable and unrestricted right to use and publish photographs for portfolio, marketing, advertising, and promotional purposes in any medium.
- If Client wishes to restrict usage, a written request must be submitted prior to the event.
9. Client Responsibilities
- Client shall ensure cooperation from wedding party and guests for group photos and key moments.
- Photographer is not responsible for missed moments due to delays, uncooperative subjects, or restricted venue access.
10. Limitation of Liability & Data Loss
- In the unlikely event of unforeseen circumstances (illness, accident, equipment failure, corrupted memory cards, or accidental file loss), Photographer’s liability is limited to a partial or full refund of all monies paid, up to the amount received.
- Photographer will take every reasonable precaution to safeguard captured files, including using professional-grade equipment and backup systems. However, no method of storage is 100% risk-free, and Client accepts this inherent risk.
- Photographer is not liable for any indirect, consequential, or incidental damages.
11. Meals & Breaks
- For events exceeding 6 hours, Client agrees to provide a vendor meal and reasonable break time for Photographer.
12. Force Majeure
- Neither party shall be liable for failure to perform obligations due to causes beyond control (e.g., natural disasters, acts of God, pandemic restrictions).
